The Regulations on the Public council under the Archive of the President of the Republic of Kazakhstan
1. General provisions
1. This Regulation defines the competence, the procedure for the activity and formation of the Public Council under the Archives of the President of the Republic of Kazakhstan (hereinafter - the Public Council), the mechanism of interaction, as well as the procedure and conditions for the inclusion of independent experts, representatives of interested public organizations and other persons in its composition.
2. The Public Council is a permanent consultative, advisory and supervisory body contributing to the activities of the Archive of the President of the Republic of Kazakhstan.
3. The decisions of the Public Council are of a recommendatory nature and are mandatory for consideration.
4. The Regulations on the Public Council, its composition and amendments made to them, are approved by the order of the Director of the Archive of the President of the Republic of Kazakhstan.
5. The Public Council fulfills its activities on the basis of the Constitution of the Republic of Kazakhstan, the Law of the Republic of Kazakhstan dated December 22, 1998 "On the National Archival Fund and Archives", the Law of the Republic of Kazakhstan dated November 2, 2015 "On Public Councils", other regulatory legal acts, methodological recommendations, as well as this Regulation.
6. The task of the Public Council is to assist the Archive of the President of the Republic of Kazakhstan in ensuring the resolution of issues in the field of its activities.
7. Organizational and technical support for the activities of the Public Council is provided by the Archive of the President of the Republic of Kazakhstan.
2. Competence of the Public Council
8. The Public Council has the right to:
1) put forward, support and consider initiatives of citizens of the Republic of Kazakhstan, public associations, organizations, government bodies in the field of activities of the Archive of the President of the Republic of Kazakhstan;
2) hold hearings on priority areas of archival activities;
3) consider draft regulatory legal acts related to the scope of the Archive of the President of the Republic of Kazakhstan (draft strategies, concepts, programs for medium-term, long-term sectoral development, budget plans, target programs) and develop recommendations on them;
4) consider the most important issues related to the scope of the Archive of the President of the Republic of Kazakhstan and offer the necessary recommendations;
5) consider other issues on presentation and agreement with the management of the Archive of the President of the Republic of Kazakhstan.
9. To exercise these rights, the Public Council is assigned with the following powers:
1) to invite to meetings of the Public Council representatives of institutions and organizations - sources of acquisition, public associations and organizations, as well as the Archive of the President of the Republic of Kazakhstan;
2) to create, on issues within the competence of the Public Council, commissions and working groups, which may include, in agreement with the director of the Archive of the President of the Republic of Kazakhstan, representatives of institutions and organizations - sources of acquisition of the Archives of the President of the Republic of Kazakhstan, state archives, public associations and organizations;
3) to organize public examinations of draft regulatory legal acts developed by the Department of archival affairs and documentation of the Ministry of culture and sports of the Republic of Kazakhstan, the Archive of the President of the Republic of Kazakhstan;
4) in agreement with the Archives of the President of the Republic of Kazakhstan, to participate in meetings of the Directorate of the Archive of the President of the Republic of Kazakhstan, held in accordance with the work plan;
5) in agreement with the Archive of the President of the Republic of Kazakhstan, to post information about the work of the Public Council on the website of the Archive of the President of the Republic of Kazakhstan.
3. Procedure for the formation of the Public Council
10. The composition of the Public Council is formed in agreement with institutions and organizations that delegate their employees to participate in the work of the council.
11. Members of the Public Council may be persons who show interest in the development of archives in the Republic of Kazakhstan and the activities of the Archives of the President of the Republic of Kazakhstan.
12. The powers of a member of the Public Council are terminated in the event of:
1) the expiration of term of office;
2) submission of an application for resignation from the Public Council.
13. Members of the Public Council perform their duties on a voluntary basis.

The Public Council is formed on the basis of voluntary participation of citizens of the Republic of Kazakhstan in its activities. The Public Council includes experts, representatives of interested public organizations and other persons.
15. The quantity of the members of the Public Council is no more than 7 persons.
16. The chairman and secretary of the Public Council are elected at its first meeting from among the candidates nominated by the members of the Public Council by open vote.
17. The composition of the Public Council is approved by the order of the Director of the Archive of the President of the Republic of Kazakhstan.
4. Procedure for the activities of the Public Council
18. The Public Council fulfills its activities in accordance with the work plan agreed with the Director of the Archive of the President of the Republic of Kazakhstan and approved by the Chairman of the Public Council.
19. The main form of activity of the Public Council is meetings, which are held at least once a quarter and are considered competent in the presence of at least half of its members. By decision of the Public Council, an extraordinary meeting can be held, as well as an absentee meeting, the minutes of which are drawn up by poll.
20. Decisions are taken by an open vote by a simple majority of votes (from the number of those present).
21. The decisions of the Public Council are reflected in the minutes of its meetings, copies of which, if necessary, are transmitted by the secretary to the members of the Public Council. Information on the decisions of the Public Council, the conclusions and results of examinations approved at the meetings of the Public Council on the considered draft regulatory legal acts and other documents, as well as reports twice a year on the results of the activities of the Public Council must be published on the website of the Archive of the President of the Republic of Kazakhstan.
22. Chairman of the Public Council:
1) makes proposals to the management of the Archive of the President of the Republic of Kazakhstan on clarifying and supplementing the composition of the Public Council;
2) organizes the work of the Public Council and presides over its meetings;
3) signs minutes of meetings and other documents of the Public Council;
4) forms, with the participation of members of the Public Council, and approves the work plan, agenda of the meeting, the composition of experts and other persons invited to the meeting of the Public Council;
5) interacts with the management of the Archive of the President of the Republic of Kazakhstan on the implementation of decisions of the Public Council;
6) makes a decision, if necessary, on holding an absentee meeting of the Public Council, decisions at which are made by polling its members;
7) in the event of absence from the sitting, appoints the chairperson promptly.
23. Members of the Public Council have the right to:
1) make proposals on the formation of the agenda for meetings of the Public Council;
2) to head commissions and working groups formed by the Public Council;
3) propose experts for participation in meetings of the Public Council;
4) participate in the preparation of materials on the issues under consideration;
5) present their position on the results of the materials considered when holding a meeting of the Public Council by means of a poll within a period not exceeding 10 days from the date of sending them the materials;
6) provide assistance to the Archives of the President of the Republic of Kazakhstan in the development of draft regulatory legal acts and other legally significant documents;
7) freely leave the Public Council of their own free will.
24. Members of the Public Council:
1) have equal rights when discussing issues and voting;
2) are obliged to personally participate in meetings of the Public Council and have no right to delegate their powers to other persons;
3) do not have privileges for access to documents of the Archival Fund, other archival documents and information resources formed on their basis.
25. Secretary of the Public Council:
1) notifies the members of the Public Council about the date, place and agenda of the upcoming meeting, as well as about the approved work plan of the Public Council;
2) prepares and agrees with the Chairman of the Public Council draft documents and other materials for discussion at meetings of the Public Council;
3) keeps, draws up and sends to the members of the Public Council the minutes of meetings and other documents and materials;
4) stores the documentation of the Public Council and prepares, in accordance with the established procedure, documents for transferring to the Archives of the President of the Republic of Kazakhstan;
5) in the event of a meeting of the Public Council, by polling its members, ensure that all members of the Public Council are sent the necessary materials and collect their opinions based on the results of consideration of the materials;
6) prepares and agrees with the chairman of the Public Council the composition of information on the activities of the Public Council, which is mandatory for posting on the official website of the Archive of the President of the Republic of Kazakhstan.
26. The term of office of the members of the Public Council expires in three years from the date of the first meeting of the Public Council of the new composition.
